These Terms & Conditions ("Terms") govern the use of the employment placement and recruitment services ("Services") of LCH GmbH, Konrad-Adenauer-Ufer 39, D-50668 Cologne ("LCH JOBS") by job seekers ("Candidates") and companies ("Employers") using the website www.lchjobs.com.
LCH JOBS is registered as a legal service provider pursuant to Section 10 Paragraph 1 Sentence 1 No. 1 RDG and facilitates matching between candidates and employers in Germany. Specific services include:
LCH JOBS does not itself become the employer or employee in any placed employment relationship; the employment contract is concluded exclusively between the Candidate and the Employer.
Candidates and Employers agree to provide truthful and complete information during registration and throughout use of the Services, and to update it in case of changes. In particular, Candidates must provide accurate information regarding qualifications, work experience, and work authorization status. Employers must provide accurate information regarding their company and the position offered.
LCH JOBS makes reasonable efforts to carefully pre-select and match Candidates and Employers, but does not guarantee that an employment relationship will result, nor the suitability of any introduced candidate or employer. The final decision on hiring or contract conclusion rests solely with the parties to the respective employment relationship.
Our fees and placement charges vary depending on the specific employment opportunity, employer, position, and type of employment.
**For Candidates:**
Candidates are required to pay applicable placement or recruitment fees, where applicable. The amount may vary depending on the **employer, position, employment type, and specific placement arrangement**. The applicable fee and payment terms will be communicated clearly to the candidate before the placement is finalized.
**For Employers:**
Employers may be required to pay a placement fee or commission upon the successful placement of a candidate. The applicable fee, payment due date, and payment terms will be determined and mutually agreed upon in the respective contract with the employer.
All applicable fees and payment obligations will be communicated transparently to candidates and employers before entering into the relevant placement agreement.
Registration as a Candidate or Employer may be terminated by either party at any time, without giving reasons, in text form (e.g. by email). Upon effective termination, stored profile data will be deleted or blocked, unless statutory retention obligations apply.
The processing of personal data in connection with the use of our Services is carried out in accordance with our Privacy Policy.
LCH JOBS is liable without limitation for intent and gross negligence, as well as under the Product Liability Act and for injury to life, body, or health. For ordinary negligence, LCH JOBS is liable only for breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper execution of the contract and on whose observance the contracting party may regularly rely – in such case, liability is limited to foreseeable damage typical for this type of contract.
LCH JOBS reserves the right to amend these Terms with effect for the future, where required for legal or technical reasons. Registered users will be informed of material changes by email.
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is Cologne.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
